Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of the FireHQ platform and website. By creating an account or accessing the platform, you agree to these Terms on behalf of yourself and the agency you represent.
2. Accounts and Access
Access to the platform is invite-only and managed by your agency administrator. You are responsible for keeping credentials confidential, for all activity under your account, and for notifying your administrator of any unauthorized access.
3. Permitted Use
FireHQ is licensed for use by your agency to manage personnel, apparatus, equipment, inventory, inspections, maintenance, and related operational data. You may not (a) resell, sublicense, or commercially exploit the platform; (b) reverse engineer or attempt to extract source code; (c) interfere with platform security or other agencies' data; or (d) use the platform in violation of law.
4. Customer Data
Your agency retains ownership of all data it enters into the platform. You grant FireHQ a limited license to host, process, and display that data solely to provide the service. You are responsible for the accuracy, legality, and appropriate use of agency data.
5. Service Availability
We work to provide a reliable service but do not guarantee uninterrupted availability. We may perform scheduled maintenance and may modify or discontinue features with reasonable notice.
6. Fees
Pricing is tailored to agency size and operational requirements and is governed by the order form or agreement between FireHQ and your agency.
7. Confidentiality
Each party agrees to protect the other's confidential information using at least the same care it uses for its own confidential information of similar importance.
8. Warranties & Disclaimer
The platform is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, FireHQ's aggregate liability under these Terms will not exceed the fees paid by your agency in the twelve months preceding the claim. FireHQ will not be liable for indirect, incidental, special, or consequential damages.
10. Termination
Either party may terminate access in accordance with the governing order form or for material breach. Upon termination, your agency may export its data for a reasonable period before deletion.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the platform or to agency administrators.
12. Governing Law
These Terms are governed by the laws of the United States and the state in which FireHQ is organized, without regard to conflicts of law principles.
